Tree Removal & Pruning Permit
The City of Morgan is committed to promoting the preservation and establishment of a diverse and healthy tree canopy. Trees are highly valued in our community and are vital to the health and character of Morgan Hill.
The City requires an approved Tree Removal & Pruning Permit prior to the removal or pruning of any protected tree, significant tree, street tree, or community of trees pursuant to Morgan Hill Municipal Code Chapter 12.32 Protected and Significant Trees (PDF)
Tree Removal and Pruning Application and Information
As part of your application, you will be required to post a Public Notice either on the tree or in a visible location for the public to view. Staff will email you a public notice for you to print. You will need to keep the posting affixed for a minimum of 10 days.

What are protected trees?
A “protected tree” is defined as:
Any native tree, significant tree, any tree designated for protecting during review and approval of a development project, public or street trees, or otherwise designated as significant status.
Examples of specific species that are protected include Oak trees (all types), California Bays, Madrones, Sycamore, and Alder trees.
What is the difference between a protected tree and a significant tree?
A “protected tree” and a “significant tree” are types of trees that require an approved permit before they can be removed or pruned. The definition of a protected tree includes “significant trees” because significant trees are protected due to their size.
A significant tree is any native tree that has a trunk diameter of 6 inches or more, and any nonnative tree that has a trunk diameter of 13 inches or more.
Do I need a permit to remove or prune a tree in my backyard?
An approved permit is required prior to the removal or pruning of protected trees that have a trunk diameter of 6 inches or more. A permit is necessary regardless of the location of the protected tree on your private property. Tree trimming does not require a permit if you are not removing more than 25% of the tree canopy.
Do I need to plant a replacement tree if I remove a protected tree?
Yes. It is required that you plant a replacement tree of the same or similar native tree species after you receive an approved permit and remove the protected tree. If the same species cannot be replaced or if there is difficulty in planting a new tree at the same location, an alternative tree species or location can be approved at the discretion of the Development Services Director.
How do I submit and pay for a Tree Removal or Pruning Application?
Once you have completed the Tree Removal & Pruning Application and included the required information, please email your application to: planning@morganhill.ca.gov
After we have reviewed your application to ensure it is complete, a Planner will contact you by email with the fees and your preferred method of payment. Please note there is a 2.7% service fee applied to all credit card transactions. There is no service fee for payment by check.
The current fee for one application to remove or prune 4 protected trees is $148.80. You must pay the fee for each application submitted. Your application will not be reviewed until we receive payment of fees.
I need to remove a hazardous tree immediately. Do I need a permit before I remove it?
No. You do not need a permit immediately in cases of emergencies (e.g., immediate removal is necessary for safety of life or property). However, you must report the removal to the Planning Division within 5 days of removing the tree. Payment of a retroactive tree removal permit is still required.
