In November of 2013, the City of Morgan Hill adopted a Single-Use Carryout Bag ordinance. This ordinance regulates the distribution of shopping bags by all stores and will take effect on April 22, 2014. After this date, all Morgan Hill stores can no longer distribute plastic carryout bags and must charge at least ten cents for approved paper bags.
Plastic Bag Ordinance Ordinance No. 2089 (PDF) was adopted on November 6th, 2013. This ordinance prohibits the use of plastic bags and requires paper bags distributed to be 100% recyclable and to contain a minimum of 40% post-consumer recycled content, accompanied by a ten cent charge that is kept by the store.
This ordinance is very similar to the ordinances adopted by San Jose, Sunnyvale, Mountain View, Santa Clara County and many other Bay Area communities. Results from other communities indicate that bag use is reduced by approximately 90% as customers respond by bringing their own bags or carrying out small purchases without a bag.
The main components of the ordinance are:
Plastic carryout bags are banned as of April 22, 2014
Stores must charge at least a 10 cent fee for paper bags and paper bags must meet certain standards as of April 22, 2014
No fees are paid to the city - stores retain the fees charged for paper bags
